SHIPPING/DELIVERY TERMS:
Paint Protection Film Kits, Rear Window Graphics, and Custom Murals
will be charged a flat rate of $14.99 per order, shipped in the continental
United States. This is based on regular postal or ground freight. Buyer will
pay any additional charges incurred if faster delivery is requested. Normal
retail shipments within the continental U.S. are shipped via UPS Ground,
FedEx, or by U.S. Mail. If a product is damaged or lost in transit, Buyer
agrees to assist Seller in documenting the loss or damage and filing a claim
with the carrier. All other shipments will be charged actual costs.
INVOICE TERMS:
All retail orders require payment at the time the order is placed.
Shipments will be held until credit cards are approved for payment.
Transactions are payable in U.S. dollars. Empire Clear Shield (Seller) accepts
VISA, MasterCard, Discover and American Express credit cards.
SALES TAX:
Arizona customers will be charged Arizona State Sales Tax, unless a
tax exemption certificate is furnished to Seller.
MINIMUM ORDER:
There are no minimum order requirements.
RETURN POLICY:
Buyer recognizes that all orders are custom manufactured after the
order is placed. Under most circumstances, any request to return the product
due to reasons other than product defect or incorrect shipment will be
disallowed. In cases where there is a high probability that the product will
be resold, Seller may, at its discretion, allow a return. No merchandise is to
be returned without first obtaining a return authorization approval from
Seller. Please advise of customer name, invoice number and date, and reason
for your desire to return. Under no circumstances may merchandise be returned
after thirty (30) days from invoice date. Any authorized returns must be
carefully packed and in saleable conditions to be accepted for credit. There
will be a fifteen percent (15%) restocking charge on all returned product when
Seller does not cause request for return. All returned merchandise must be
shipped insured freight prepaid. We will issue a credit memo or cash refund on
all returned merchandise within two (2) business days of receipt of an
authorized return.
CANCELLATIONS:
Most items may not be cancelled after being produced by Seller.

LIMITATION OF LIABILITY:
Any liability for consequential and incidental damage is expressly
disclaimed. Seller’s liability in all events is limited to and shall not
exceed the purchase price paid.
CONTROLLING LAW:
The validity, construction and enforcement of the purchase agreement
between Buyer and Seller shall be governed by and interpreted under the laws
of the State of Arizona. In the event of any dispute arising out of this
agreement, Buyer agrees to the personal jurisdiction of the federal and/or
state courts located in the County of Maricopa, State of Arizona, and Buyer
consents to service of process by United States Mail at the billing address
and Buyer waives any objection to venue.
INSTALLATION DISCLAIMER:
Seller makes every effort to assure that all precut paint protection
film kits have been test fit or otherwise checked for fit and suitability for
the specific make and model advertised. Despite the fact that thousands of
retail customers have been successful in installing this product themselves, a
professional quality installation does require some skill on the part of the
installer for which Seller cannot be held accountable. Seller is limited to
providing installation instructions or advice via a toll-free telephone
number. The purchase and installation of Seller’s precut kits is a conscious
decision made by the Buyer and done so at the Buyer’s risk. In an effort to
provide Buyer with a satisfactory recourse in case a piece of the precut film
kit is damaged or improperly installed by the Buyer (or Buyer’s installation
agent) during an installation attempt, Seller agrees to replace one piece from
any kit at half the price paid for that piece if originally purchased as part
of a full standard or deluxe paint protection kit. Additionally, at Buyer’s
request, Seller will make every effort to locate a professional installer
within reasonable driving distance of the Buyer. Buyer acknowledges
understanding at this point in time there is no formal industry-wide
certification system to identify installers capable of achieving professional
results. It is incumbent on the Buyer to determine whether or not Buyer feels
comfortable with the experience level and capabilities of the installer Buyer
selects. Seller’s liability will cover defects in film or finished product
attributes only and will not extend to the quality of the installation unless
performed by Seller’s employees.

PAINT PROTECTION FILM WARRANTY
|
3M designs, formulates and manufactures Scotchgard Paint Protection Film for
optimum performance and durability. The 3M commitment to quality is the
foundation for the warranty coverage Seller provides.
3M warrants to Seller’s direct customers that Seller’s Paint Protection
Film Kits will be free of defects in materials and manufacture -- including
yellowing, bubbling, or cracking -- for five (5) years from the date of
purchase. This warranty does not apply to damage caused by misuse, accident,
misapplication or ordinary wear, nor does it apply to dents caused by physical
impact of rocks or road debris.
The 3M warranty stated herein is exclusive and is made in place of all
other express or implied warranties, including any implied warranty of
merchantability of fitness for a particular purpose. 3M will replace or refund
the purchase price on any film kit that does not meet this warranty. This is
the exclusive remedy and 3M shall not be liable for any other damages,
including incidental or consequential damages, arising out of the use or
inability to use Seller’s Paint Protection Film or any vehicle to which it has
been applied.
